Terms of Service

These Terms of Service ("Terms") govern your use of nyxelai.com and the services offered by Nyxel AI ("Nyxel," "we," "us"). By using our website or purchasing our services, you agree to these Terms. Paying clients also agree to a separate Service Agreement, which controls if there is any conflict.

The service

Nyxel provides AI voice "employees" that place and/or answer calls and book appointments on a client's behalf, operated on Nyxel-owned infrastructure. Features, pricing, and availability may change over time.

Fees & billing

Prices are shown at checkout. One-time products (such as a Reactivation Sprint) are charged once; subscription products (such as the AI Front Desk) auto-renew until cancelled. Payments are processed by our third-party payment provider.

Guarantee & refunds

Any performance guarantee (for example, the Reactivation Sprint "booked jobs" guarantee) applies only as described in your Service Agreement and only when its conditions are met. Except as expressly stated there, fees are non-refundable. A "booked job" is counted when the appointment is scheduled; what a customer does afterward is outside our control.

Pay-Per-Booking

We also offer a pay-per-booking option: no upfront or monthly fee, and you pay a flat $50 for each appointment our AI books onto your calendar. It is governed by the Pay-Per-Booking Service Agreement, which controls for that offer.

Your responsibilities

You agree to provide accurate information, and you represent that you have the legal right and any required consent to contact any individuals on lists you provide, including under the U.S. Telephone Consumer Protection Act (TCPA) and applicable state law. You are responsible for the lawfulness of the lists and content you provide.

Acceptable use

You may not use our services for unlawful, deceptive, harassing, or abusive purposes, or in violation of telemarketing, do-not-call, or consumer-protection laws.

No guarantee of results

Except for a guarantee expressly stated in your Service Agreement, we do not guarantee any specific number of calls, bookings, revenue, or outcomes.

Limitation of liability

To the maximum extent permitted by law, Nyxel's total liability arising out of the services is limited to the amount you paid us in the prior one (1) month (for subscriptions) or the fee for the applicable one-time product. We are not liable for indirect, incidental, or consequential damages.

Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules.
